According to the criminal code, wiretaps can only be sanctioned by a court. Unauthorized surveillance carries a prison sentence of up to four years.
There have been five complaints filed so far, by Mitchell Doens, Balbina Herrera, Bernabé Pérez, Miguel Antonio Bernal and Luis José Varela. All have been filed against Martinelli for allegedly ordering the wiretaps.
So far, two people have been charged in the case. They are Gustavo Pérez and Alejandro Garuz, both former executive secretaries of the National Security Council, who are both detained at La Gran Joya Prison.
