Martinelli lawyers present appeal to TE

The former president was stripped of his electoral immunity.

Lawyers for former President Ricardo Martinelli (2009-2014) filed today an application for reconsideration of the Tribunal Electoral (TE) decision which stripped him of his immunity.

The decision was based on a request of the plenum of the Supreme Court to investigate a complaint brought against the former president for alleged irregularities in the National Assistance Program (PAN).

Dimas Guevara, a lawyer for Martinelli, explained that the investigation against his client has "procedural faults." He said that the TE did not take into account the fact there is "no strong evidence" against his client.

"His constitutional and fundamental rights have been violated," said Guevara, who was accompanied by the lawyers Rogelio Cruz, Alma Cortés and Cristóbal Arboleda.

Martinelli, who left the country Jan. 28, enjoyed immunity as president and legal representative of the Democratic Change (CD) party.
